1. About us

These Terms and Conditions ("Terms") govern the supply of goods through youevolve.life (the "Site") by Mojo Nutrition BV ("Mojo", "we", "us", "our"), trading under the brand evolve®.

By placing an order, creating an account, or using the Site, you confirm you accept these Terms and the documents referenced in them (Privacy Policy, Cookie Policy, Shipping Policy, Refund Policy, Legal Notice). If you do not accept these Terms, do not use the Site.

2. Eligibility

You must be at least 18 years old to place an order. By placing an order you confirm that you are 18 or over and legally able to enter a binding contract.

3. The contract between us

3.1 Our display of products on the Site is an invitation to treat, not a contractual offer.

3.2 When you place an order you make a contractual offer to buy. We confirm receipt by automated email; this email is not acceptance.

3.3 A binding contract is formed only when we send a separate dispatch confirmation email. Until that point we may decline the order without liability, including for pricing errors, stock unavailability, suspected fraud, or breach of these Terms.

3.4 If we cannot fulfil an order we will refund any payment in full within 14 days.

3.5 At checkout the order-confirmation button is labelled "Order with obligation to pay" (bestelling met betalingsverplichting) in line with EU Directive 2011/83 art. 8(2) and Dutch Civil Code (BW) art. 6:230v(3).

4. Products, food supplement disclaimer, and safety

4.1 Descriptions. We take reasonable care to describe products accurately. Photography and packaging may vary slightly from the product supplied.

4.2 Food supplements, not medicines. Our products are food supplements regulated by EU Directive 2002/46/EC as implemented in the Netherlands by the Warenwetbesluit Voedingssupplementen. They are not medicinal products under Directive 2001/83/EC / the Dutch Geneesmiddelenwet. They are not intended to diagnose, treat, cure, prevent, or mitigate any disease.

4.3 No medical advice. Content on the Site is provided for general information only. It is not medical, nutritional, or diagnostic advice. Always consult a qualified healthcare professional before starting any new supplement; before changing your diet, training, or sleep protocol if you have an underlying medical condition; and before using any supplement if you are pregnant, breastfeeding, planning pregnancy, under 18, taking prescription medication, or have a known medical condition.

4.4 Health and nutrition claims. We only make health and nutrition claims authorised under Regulation (EC) 1924/2006 and listed in the EU Register of nutrition and health claims. We do not make disease-prevention or disease-treatment claims, implied medical claims, or claims about rate or amount of weight loss.

4.5 Individual results. Any references to effects, outcomes, or experiences are not guarantees. Individual results depend on diet, training, sleep, stress, age, baseline status, medication, and many other factors outside our control.

4.6 Always read the label. Do not exceed the recommended daily intake. Food supplements should not be used as a substitute for a varied, balanced diet and healthy lifestyle. Keep out of reach of young children.

4.7 Allergens. Allergen information complies with EU Regulation 1169/2011 (FIC) and is shown on each product page and on the product packaging. Always check the label if you have a known allergy or intolerance.

4.8 Storage and use. Store products as directed on the label. Do not use after the best-before date printed on the pack. If the seal is broken on receipt, contact us before use.

4.9 Adverse reactions. If you experience an adverse reaction, stop use immediately and consult a healthcare professional. Report adverse reactions to hello@youevolve.life. Serious adverse events relating to food may also be reported to the Nederlandse Voedsel- en Warenautoriteit (NVWA) at nvwa.nl.

5. Price and payment

5.1 Prices are shown in euro (€) and include BTW (Dutch VAT) at the prevailing rate where applicable. Delivery charges are shown separately at checkout.

5.2 We use [FILL: Shopify Payments / Mollie / Stripe] to process payment. We do not store full card details.

5.3 If a pricing error is discovered before dispatch, we will contact you to confirm whether you wish to proceed at the corrected price or cancel for a full refund.

6. Delivery

Delivery is governed by our Shipping Policy. Risk passes to you on delivery to the address you supplied (BW art. 7:11). Title passes once payment has cleared in full.

7. Your right of withdrawal (14-day cooling-off)

7.1 Under EU Directive 2011/83 (Consumer Rights) as implemented in Dutch law by BW art. 6:230o you have a statutory right to withdraw from a one-off purchase within 14 calendar days of the day after you (or someone you nominate) take physical possession of the goods. You do not need to give a reason.

7.2 To exercise the right of withdrawal, notify us in writing to hello@youevolve.life with your order number and a clear statement of withdrawal. You may use the model withdrawal form in Schedule 1.

7.3 You must return the goods within 14 days of telling us you wish to withdraw. Return postage is at your cost (BW art. 6:230s(2)) unless the goods are faulty or not as described.

7.4 We will refund the price paid and standard outbound delivery within 14 days of receiving the returned goods or proof of return, whichever is earlier (BW art. 6:230r). We may reduce the refund for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

7.5 Health and hygiene exception. For hygiene reasons we are unable to accept returns of food supplement products where the inner seal is broken (BW art. 6:230p(f)(2), implementing Directive 2011/83 art. 16(e)). This does not affect your rights for faulty or misdescribed goods.

8. Conformity and warranty (BW art. 7:17)

8.1 Goods must conform to the contract: be of satisfactory quality, fit for purpose, and as described. This is the legal conformity guarantee under BW art. 7:17 and EU Directive 2019/771.

8.2 If goods are non-conforming, you are entitled in the first instance to repair or replacement. If neither is possible or proportionate, you may claim a price reduction or full refund (BW art. 7:21).

8.3 Notify any defect within a reasonable time of discovery and in any event within two months (BW art. 7:23(1)).

8.4 The right of legal conformity is in addition to your statutory right of withdrawal in clause 7 and is not limited by any commercial warranty we may offer.

9. Subscriptions

If you place a subscription, the following additional terms apply alongside the Subscriptions page:

9.1 A subscription is a recurring contract. Payment is taken on each scheduled billing date until you cancel.

9.2 You may pause, skip, edit, or cancel a subscription at any time from your account or by emailing hello@youevolve.life. Cancellation takes effect for any order not yet processed at the time of cancellation. Cancellation must be at least as easy as the subscribe flow (Directive (EU) 2019/2161 "Omnibus", transposed into BW art. 6:230v).

9.3 Price changes will be notified by email at least [FILL: 14 / 30] days before the next billing date. You may cancel without charge before the new price applies.

9.4 Your 14-day right of withdrawal under clause 7 applies to the first delivery of a new subscription. Subsequent deliveries are governed by clauses 9.1 to 9.3.

10. Promotions, discount codes, gifts

10.1 Discount codes are single-use unless otherwise stated, cannot be combined, and cannot be applied retrospectively.

10.2 We reserve the right to refuse or withdraw a promotion in case of abuse, error, or breach of these Terms.

10.3 Free gifts have no cash value and cannot be refunded for cash.

11. Site use and account security

11.1 You are responsible for keeping account credentials confidential. You are responsible for all activity under your account.

11.2 You agree not to use the Site (a) for any unlawful purpose; (b) to transmit malicious code; (c) to scrape, copy, or replicate content; (d) to circumvent security features; (e) to infringe our intellectual property or that of any third party.

11.3 We may suspend or terminate your account if we reasonably believe you are in breach of these Terms.

12. Intellectual property

All trade marks, logos, product names, photography, copy, formulations, and Site content are owned by Mojo or licensed to us. "evolve®" is a registered trade mark in the Benelux [FILL: BOIP number] and the European Union [FILL: EUIPO number]. Nothing on the Site grants you any licence to use any of these without our prior written consent.

13. User reviews and submissions

13.1 By submitting a review, photo, comment, or other content you grant us a worldwide, royalty-free, non-exclusive, perpetual licence to use, reproduce, adapt, and publish that content in connection with our business.

13.2 You confirm that the content is original, accurate, lawful, and does not infringe any third-party rights.

13.3 We may remove or refuse to publish any submission at our discretion.

14. Liability

14.1 Nothing in these Terms limits or excludes our liability for (a) death or personal injury caused by our negligence; (b) intent or gross negligence; (c) any matter for which liability cannot be limited or excluded by law (incl. product-liability claims under BW art. 6:185 et seq. and Directive 85/374/EEC).

14.2 Subject to clause 14.1, our total liability to you for any claim arising out of or in connection with these Terms shall not exceed the price paid for the goods that gave rise to the claim.

14.3 We are not liable for indirect or consequential loss, loss of profit, loss of business, or loss of opportunity.

14.4 We are not liable for any failure or delay caused by events outside our reasonable control (force majeure / overmacht, BW art. 6:75).

15. Privacy and cookies

We process personal data in accordance with our Privacy Policy and use cookies in accordance with our Cookie Policy, under EU Regulation 2016/679 (GDPR) and the Dutch implementation act UAVG.

16. Changes to these Terms

We may update these Terms from time to time. The version that applies to your order is the one in force at the time of order. Material changes will be notified by email to account holders and posted on this page at least [FILL: 14 / 30] days before they take effect.

17. Complaints, ADR, and ODR

17.1 We aim to resolve complaints within [FILL: e.g. 5 working days]. Contact hello@youevolve.life.

17.2 If a complaint cannot be resolved, EU consumers may use the Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr (EU Reg 524/2013).

18. Governing law and jurisdiction

These Terms are governed by the laws of the Netherlands, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The competent courts of the Netherlands have jurisdiction, except that where you are a consumer you may also bring proceedings in the courts of your country of habitual residence (EU Regulation 1215/2012 (Brussels I bis) art. 18), and you retain any mandatory protection of the consumer law of that country (EU Regulation 593/2008 (Rome I) art. 6).

19. Severability

If any clause of these Terms is found to be unenforceable, the remaining clauses continue in full force.

20. Entire agreement

These Terms, together with the documents referenced in them, form the entire agreement between you and us in respect of their subject matter.
